TARGET AUDIENCE

Valuable for all brokers managing commercial clients and/or looking to learn about the management of commercial clients. Part 1 is particularly relevant for Young Professionals and those new to undertaking contract reviews. The audience can attend one or both sessions, your ticket secures a spot to both.



OVERVIEW

This seminar consists of two parts:


PART 1 - CONTRACT REVIEW

Dos and Don'ts of Review Contracts for Insurance Brokers


In this session, LMI Legal's Senior Associate, Jack Chen will shed light on what a broker should and should not be advising on when reviewing contracts in their capacity as an insurance broker.


You will obtain an understanding of the typical issues which will be presented to you when asked to review a contract for a client in relation to indemnities, hold harmless clauses and contractual liabilities.



PART 2 - BREACH REPORTING

An Insurance Broker's Duties: Understanding your duties and how to avoid breaching them


In this session, Hall & Wilcox's Partner, Bridget Wall will delve into decisive court rulings that have shaped the landscape for the scope of the duty owed by an insurance broker.


Gain valuable insight into the types of claims that are frequently made against brokers, how to navigate a claim or an AFCA complaint against you and tips to ultimately avoid a professional indemnity claim being made against you.



KEY LEARNINGS

  • Minimise the likelihood of being on the receiving end of a complaint.
  • Good file management(keeping records, taking file notes, ensuring you keep a paper trail).
  • Creating check lists of key concepts that have been explained to a client (e.g. underinsurance, sufficiency of sums insured, key exclusion clauses, disclosure obligations, etc.)
  • Getting to know your client and their business to properly understand their insurance needs.
  • How to manage complaints or potential for complaints
